Terms of Service

1.About MarieChic

MarieChic is a luxury ecommerce platform operated in Nairobi, Kenya.

We operate in accordance with Kenyan law, including the Consumer Protection Act (2012), the Data Protection Act (2019), and the Kenya Information and Communications Act.

2.Acceptance of Terms

By accessing the MarieChic website, creating an account, subscribing to our newsletter, or completing a purchase, you confirm that:

• You are at least 18 years of age or have legal capacity under Kenyan law
• You have read and agree to be bound by these Terms in their entirety
• You agree to our Privacy Policy, which is incorporated herein by reference
• If acting on behalf of a business entity, you have authority to bind that entity

Continued use of the Service following any update to these Terms constitutes your acceptance of the revised Terms.

3.User Accounts & Authentication

Account Creation

You may register using a valid email address and password, or by authenticating via Google OAuth. Both methods are supported by our authentication infrastructure. All information you provide must be accurate and current.

Google OAuth

When you sign in with Google, you authorise MarieChic to receive your name and email address as permitted by your Google account settings. We do not store your Google password and do not access any other Google services. Your continued access via Google OAuth is subject to Google's own Terms of Service.

Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account, whether or not authorised by you
• Immediately notifying us at support@mariechic.com if you suspect unauthorised access
• Logging out at the end of sessions on shared or public devices

Password Reset

Password reset is available for email/password accounts only. Reset links are sent to your registered email address and expire shortly for security. We will never ask for your password via email or phone. Google OAuth users manage authentication through their Google account settings.

One Account Per User

Creating multiple accounts to circumvent restrictions, obtain promotional benefits, or for any deceptive purpose is prohibited and may result in immediate suspension of all associated accounts.

4.Orders & Purchases

Contract Formation

When you place an order, you are making an offer to purchase. A binding contract forms only when we send your order confirmation email confirming dispatch. Product listings on the website constitute an invitation to treat, not an offer.

Payment

We accept M-Pesa. All transactions are processed in Kenyan Shillings (KES).

Order Cancellation

Once an item is sold it cannot be cancelled, only order exchanges. For faulty items refer to the Return Policy Page

Taxes & Duties

Prices displayed are inclusive of applicable VAT where required by Kenyan law.

5.Product Availability & Pricing

All products are subject to availability. If an item you have ordered becomes unavailable after your order is placed, we will notify you promptly and offer a substitute, or full refund.

We reserve the right to change prices at any time. In the event of a pricing error, we are not obligated to honour the incorrect price and may cancel any orders placed at an erroneous price, with a full refund issued.

Promotional codes cannot be combined unless explicitly stated, cannot be applied retrospectively, and are non-transferable.

6.Email Communications

Transactional Emails

We send essential transactional emails including order confirmations, shipping updates, password reset emails, and security alerts. These are required to operate the Service and cannot be opted out of while your account is active.

Marketing & Newsletter

Marketing emails are sent only with your explicit consent. You may withdraw consent at any time by clicking Unsubscribe in any marketing email or contacting privacy@mariechicke.com.

7.Prohibited Uses

You agree not to use the MarieChic platform to:

• Impersonate another person or misrepresent your affiliation with any entity
• Access accounts or data you are not authorised to access
• Use automated tools to scrape or extract data without written consent
• Exploit the password reset flow, and any authentication mechanism to gain unauthorised access
• Transmit malware, viruses, or malicious code
• Engage in credential stuffing, brute force, or any attack on account security
• Place fraudulent orders or use stolen payment credentials
• Create multiple accounts to circumvent restrictions or obtain unfair advantages
• Reverse-engineer or attempt to extract the source code of the platform

8.Intellectual Property

Our Content

All content including the brand name, logo, trade dress, website design, product photography, written copy, and software is the exclusive property of MarieChic or its licensors and is protected under Kenyan and international intellectual property laws.

User Content

If you submit reviews, photos, or other content, you grant MarieChic a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, and display that content in connection with our business. You represent that you own all rights to any content you submit.

9.Limitation of Liability

To the maximum extent permitted by Kenyan law, MarieChic, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

10.Termination & Suspension

Termination by You

You may delete your account by contacting support@mariechicke.com. Termination does not entitle you to a refund for pending or completed orders.

Suspension or Termination by Us

We reserve the right to suspend or permanently terminate your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, posed a security risk to the platform, or failed to pay for orders.

11.Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising shall be subject to the exclusive jurisdiction of the courts of Kenya, specifically the courts of Nairobi.

Nothing in these Terms affects your statutory rights as a consumer under the Kenya Consumer Protection Act (2012).

12.Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and display a prominent notice on the platform. Your continued use of the Service after the changes take effect constitutes acceptance.
